The nice folks at the Washington State HP, who perform the VIN inspection, tell me I need to have an airbag in a kit car. The sent me the checklist they use and airbags is the first item. Bumpers are also on the list but I was directed to Senate Bill 5585 which exempts cars like the roadster from bumpers. It however does not exempt it from airbags.

I know these cars are getting licensed in Washington State but before I buy this (or maybe an 818, still undecided) I need to know I can license it.

Can anyone send me the law that exempts a kit car from Federal motovehicle safety laws, as this should include the airbag exemption. I would also appreciate anything that exempts a kit car from airbags under Washington State law.

Hello Mike, I know this is an older post, but the Mark III I purchased is lisenced as a Classic Car, and had those plates. No emissions, or air-bag requirements necessary. Is your car going to use Collector Car plates? Perhaps that is the loop-hole...?

The WSP VIN inspection is NOT an equipment/safety inspection. Your greatest worry is having original receipts and MSO/MCOs for major components. The VIN officers are verifying this information when presented. RCW 46.04.251, 46A.37.519 - "Kit Vehicle", RCW 46.12.560 (4)(A) WSP Inspection, WAC 308-56a-265 Documentation Required, RCW 46.80.010 Major Components, 49 CFR part 571; RCW 46.37; and WACs 204-10 Equipment Requirements. You have the correct Senate Bill which now allows us to license as a 65...

I have seen countless Cobra kit cars come through the Bellevue VIN lanes, especially - when the Senate Bill passed. There is sometimes confusion with the overlay of all the RCWs, WACs & CFRs, depending upon what is presented for inspection. If you are still concerned, speak with one of the VIN Officers at the Tacoma or Bellevue WSP VIN lanes.
