I don’t know what to do! I want to start a side business of apparel, dedicated to vintage racing cars, and replicas. I designed few models already, but I’m worry a lot about the Co*** and the Day**** shapes that I illustrated. The designs represent only the shapes of the cars, no logos, no words that could belong to who we know. But still, I was worried that our little friend would sue me for trade dress infringement.

So, I contacted CSL to see how I could use the trade dress of the Day****. Well the only way is to become a licensee of CS, then I could use whatever I want, bla bla bla… but they are also selling me the trade dress of the C**** despite the recent judgment of the US patent and trademark office, that denied him the claim of that trade dress (thank you David).

I feel like making a pact with the devil !!! What would you do? Would you go ahead and sign with Lucifer or would you ignore him and start the biz until I may receive a cease and desist or a lawsuit? I don’t want to pay for a trade dress he has no right on, I don’t want to reinforce his beliefs that he designed that AC ... Bristol.

Please send me your comments and advices, I need help …

I'd pick another abandoned shape. There are so many AC replicas already...

IMO I'd do some research on late 50's - 60's racers and pick something that was never mass produced, ie abandoned...

Hey David,
It is not a AC replica that I'm designing, it's a line of apparel illustrated with C**** and D****** and other replicas and kit cars
